Parliament adopts recast directive on legal protection of designs
Decision
The European Parliament adopted its position at first reading on 14 March 2024 on the proposal for a directive on the legal protection of designs, recorded as P9_TA(2024)0165 and based on the committee report A9-0317/2023. Parliament took that position following a provisional agreement approved by the responsible committee and an undertaking by the Council representative to approve Parliament’s position.
What Changes
The act is a recast that codifies earlier texts and the amendments identified in the proposal, and the Consultative Working Party of the legal services concluded that the proposal does not introduce substantive changes beyond those identified. Parliament instructs its President to forward the adopted position and calls on the Commission to refer the matter back to Parliament if it substantially amends or replaces the proposal.

The outcome establishes the EU-level legal framework on design protection and directly involves EU institutions including the European Parliament, the Council, the Commission and national parliaments.
