Commission issues guidance on BEV price undertaking offers from China

The European Commission has issued a Guidance Document giving Chinese exporters of battery electric vehicles to the EU general guidance on the submission of price undertaking offers. Context

The Guidance follows the Commission's finalised anti-subsidy investigation on 29 October 2024 that imposed definitive countervailing duties on BEVs from China ranging from 7.8% to 35.3%. In parallel the Commission and China have been exploring alternative WTO-compatible solutions and the Guidance issuance follows discussions between the Commission and China’s Ministry of Commerce held while the investigation was ongoing.

The Guidance clarifies procedural expectations for Chinese exporters wishing to submit price undertaking offers and provides a framework for those offers to be evaluated.
