Parliament approves conclusion of Amending Protocol to EU–Switzerland automatic exchange agreement
Decision
The European Parliament adopted its opinion approving the conclusion of the Amending Protocol to the Agreement between the EU and the Swiss Confederation on automatic exchange of financial account information, as set out in report A10-0202/2025 and the draft legislative resolution (COM(2025)0376), adopted under the simplified procedure (Rule 52) and recorded as P10_TA(2025)0273 on 13.10.2025.
What Changes
The Amending Protocol updates the Agreement to align automatic exchange with the updated OECD Common Reporting Standard and with EU rules implemented by Council Directive (EU) 2023/226 (DAC8), extends scope to cover electronic money products and central bank digital currencies and provides for interaction with the Crypto-Asset Reporting Framework, introduces mutual assistance in the recovery of VAT claims and replaces references to Directive 95/46/EC with the GDPR; the CRS modifications will apply from 1 January 2026 and corresponding DAC8 provisions will apply in the EU from that date.

The changes affect the Member States and the Swiss Confederation in relation to the reciprocal automatic exchange of financial account information and mutual assistance on VAT recovery.
