MEPs seek ECJ opinion on EU‑Mercosur agreement

Context

The European Parliament addressed the EU‑Mercosur partnership, including the EMPA and the interim trade agreement (iTA), by asking the EU Court of Justice to assess whether the agreement is compatible with the EU treaties. The action follows parliamentary consideration of the agreements' legal basis.

Key Topic

Parliament adopted a resolution to request a legal opinion from the European Court of Justice with 334 votes in favour, 324 against and 11 abstentions, while a second resolution seeking a legal assessment was rejected with 225 votes for, 402 against and 13 abstentions. The adopted resolution asks the ECJ to review the conformity of the EU‑Mercosur agreement with EU treaties.

What to Watch

The ECJ will review the legal basis of the EMPA and the iTA and Parliament will continue examining the texts while awaiting the Court's opinion, after which it will be able to vote to grant consent or not.
