European Parliament resolution seeking CJEU opinion on EU‑Singapore Digital Trade Agreement

Decision

The European Parliament adopted resolution B10‑0479/2025 and decides to seek an opinion from the Court of Justice on the compatibility of the proposed Agreement on Digital Trade between the EU and the Republic of Singapore; it instructs its President to take the necessary measures and to forward the resolution to the Council and the Commission.

What Changes

The request asks the Court to rule on Treaty compatibility and flags legal uncertainty in the agreement over safeguards for fundamental rights in the context of cross‑border data flows and the omission of privacy from the operative safeguard clause. The resolution also expresses serious doubts about provisions on access to source code and whether they constrain the Union’s ability to regulate, audit and enforce EU digital law such as the Digital Services Act, the Digital Markets Act and the Artificial Intelligence Act.

Who Is Affected

The resolution concerns the European Union and the Republic of Singapore, EU institutions including the Commission and the Council, and businesses and consumers engaged in digital trade and cross‑border data flows.
